By accessing and using this website (referred to below as the “Site”) you agree to be bound by this Privacy Policy and the Terms and Conditions, which together govern such access & use (collectively the “User Terms”).

Further, you agree that any personal data (including (without limitation) contact details such as your name, address, telephone number, email and any other data that may be used to individually identify you) (“Personal Data”) that you submit or make available to PPL and/or VPL (as such abbreviations are defined in the Terms and Conditions) through this Site will be processed in accordance with this Privacy Policy (“Privacy Policy”).

If you do not agree with the User Terms or to your Personal Data being processed as set out below, do not use this Site.

 

Binding agreement and amendments to the User Terms

By agreeing to be bound by the User Terms, you are entering into a legally binding contract between yourself and PPL. Notwithstanding that the relevant contract is with PPL, you acknowledge and agree that the User Terms grant VPL certain rights and remedies that are directly enforceable by VPL against you.

PPL may alter the User Terms at any time and from time to time without prior notice to you or your consent. Accordingly, you should ensure that you regularly review this Privacy Policy and the Terms and Conditions to keep yourself informed of such changes. By continuing to access and use the Site you confirm your agreement to the same.

Use of your Personal Data

When Personal Data is submitted by you using this Site, you acknowledge and agree that PPL and/or VPL may collect, store and process such Personal Data (which may include transferring it to relevant third parties) for the following purposes:

- Dealing with an enquiry submitted by you;
- Dealing with licence applications and licensing issues;
- Registering you (or your company/organisation) as a record company or performer member of PPL and/or member of VPL, and with other collection societies and similar bodies or organisations who provide similar services to PPL and/or VPL;
- Handling and processing of record company member claims;
- Handling and processing of performer member claims;
- Dealing with you regarding any other transactions conducted through the Site;
- Analysing usage patterns of the Site in order to determine which areas users find most valuable to them and to evaluate ways to improve the Site;
- Using such Personal Data in the manner set out in the section below headed “With whom is your Personal Data shared”;
- By PPL and/or VPL to send you information regarding PPL, VPL and/or certain third parties, and the products and services that PPL, VPL and/or certain third parties provide from time to time; and/or
- By certain third parties to whom your Personal Data is transferred (as permitted by this Privacy Policy) to send you information regarding themselves, and the products and services that they provide from time to time.

Registered Users

Certain sections of this Site are only open to registered users and give those registered users the ability to review and modify Personal Data previously provided. Where any user names; passwords; log-in details and other secure means of access are given to you in order to access your Personal Data or to use any secure section of our Site, you are responsible for security of your information and will keep such information secure at all times treating it as strictly confidential. You must notify PPL in the event that such information is revealed to or accessed by anyone else or where you become aware of a breach of confidentiality or any unauthorised use of this Site.

Personal Data provided to you

Where Personal Data relating to individuals, such as, but not limited to performer data, is made available to you on the Site, this is solely for the purpose of you being able to lawfully use the service provided by PPL and/or VPL. You must keep any such information disclosed to you confidential and not use it for any other purposes.

Cookies

PPL and/or VPL may collect information about visitors accessing the Site automatically using “cookies” or other data collection or tracking technology. (NB: A “cookie” is a text file sent to the browser on a user’s personal computer to identify that user to our Site and allowing us to personalise their visit). You can choose to switch-off or refuse these cookies at any time by changing the privacy settings on your Web browser. If you choose to decline or refuse cookies, you may not be able to experience full interactivity with our Site.

With whom is your Personal Data shared

When Personal Data is submitted by you using this Site, you acknowledge and agree that PPL and/or VPL may share your Personal Data:
- with each other;
- with other collection societies and similar bodies or organisations who provide similar services to PPL and/or VPL,
- with third party suppliers and contractors (such as website hosting companies and credit card / payment processors) for the purpose of providing you with products and services, including (without limitation) the Site, the Content and any services available on the Site;
- with relevant third parties when required by applicable law (such as when PPL and/or VPL respond to subpoenas, court orders or legal process); and
- with relevant third parties when PPL and/or VPL believes it reasonably necessary in order to investigate, prevent, or take action regarding illegal or improper activities, suspected fraud, potential threats to the rights, property or safety of PPL and/or VPL, users of the Site, or any actual or suspected violation of the User Terms,
wherever such persons and entities are located in the world.

Please note that PPL and/or VPL may collect non-Personal Data about you, such as the type of internet browsers you use or the internet website from which you linked to the Site. You cannot be identified from this information and it is only used by PPL and/or VPL to assist in providing an effective service on this Site. This information (together with Personal Data that has been aggregated with other information so that you are no longer identifiable from it) may be supplied by PPL and/or VPL to prospective partners, advertisers and other reputable third parties, but on an aggregated and anonymous basis (ie with no personally identifying information).

Transfers Overseas

As noted above, PPL and/or VPL may transfer your Personal Data to locations outside of the European Economic Area (EEA). Please be aware that the laws of most countries outside the European Economic Area are generally not regarded as providing the same level of protection for Personal Information as those of countries making up the European Economic Area (ie such countries’ laws are generally not regarded as providing “adequate" data protection as contemplated under Article 25 of the European Union's Data Protection Directive (95/46/EC)).

Security

PPL and VPL have security measures in place to protect against loss, unauthorised access, misuse, alteration and improper disclosure of the Personal Data you provide via the Site. However, no computer system or information can ever be fully protected against every possible risk and it is not possible to guarantee the security or integrity of the Personal Data you disclose online. Notwithstanding PPL’s and VPL’s security measures, you should be aware that when you submit Personal Data to the Site over the Internet, the information may travel over many systems that are not under PPL’s and/or VPL’s control.

Your rights with respect to your Personal Data

You have a legal right to a copy of all the Personal Data about you held by PPL and/or VPL. You also have a right to correct any errors in that information. You also have a right to prevent PPL and/or VPL using your Personal Data for direct marketing purposes.

Governing Law

This Privacy Policy shall be governed by and construed in accordance with English law and, in particular, the Data Protection Act 1998 and any other applicable privacy regulations (as amended, consolidated or re-enacted from time to time).
